A plan with a purpose
A Will takes effect at death. It can organize important decisions, but the right wording depends on your assets, relationships, obligations and goals.

Record how property governed by your Will is to be distributed and what should happen if a named beneficiary dies before you.
A testamentary trust can set terms for holding and using an inheritance for a child or another beneficiary who may need support.
Parents can record their wishes about decision-making responsibility for minor children. Court and statutory rules still apply.
Provide specific gifts for people or charities while coordinating them with the balance of the estate and likely expenses.
Build in alternate estate trustees and beneficiaries so the plan is less likely to fail when circumstances change.
If there is no Will
If a person dies without a valid Will, Ontario's intestacy rules determine who may inherit and who may apply to administer the estate. The result may not match the person's relationships or intentions.
A Will does not control every asset. Joint ownership, beneficiary designations, corporate interests, property outside Ontario and other legal arrangements may require separate analysis.

These answers are general. Advice for your family depends on the facts, documents and law that apply to you.
Ontario does not require a lawyer to prepare every Will, but a Will must satisfy legal requirements to be valid. A lawyer can consider capacity and signing concerns, explain the consequences of the wording, and coordinate the Will with the rest of your estate plan.
No. Whether a Certificate of Appointment is required depends on the assets, how they are owned, the institutions involved and other circumstances. A Will is important, but it does not automatically eliminate the court process commonly called probate.
Not necessarily. Some jointly owned assets, insurance proceeds and registered plans with valid beneficiary designations may pass outside the estate. Ownership and designation documents should be reviewed as part of the broader plan.
A Will takes effect at death. A Power of Attorney appoints someone to make certain decisions during your lifetime and ends at death. Many complete plans include both. Learn about Powers of Attorney.
Review it after major changes involving relationships, children, health, assets, business interests, residence, named estate trustees or beneficiaries. A periodic legal review can confirm whether the existing wording still fits.
